We reserve the right to modify these terms at any time. Your continued use of the Platform after changes are posted constitutes your acceptance of the modified terms.

2. Use of Platform

You may use our Platform to browse and purchase authentic Bo-Kaap souvenirs, arts, and crafts. You agree to use the Platform only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Platform in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the Platform
• Engage in any conduct that restricts or inhibits anyone's use of the Platform
• Use any automated system to access the Platform without our permission

4. Products and Pricing

All products sold through our Platform are authentic Bo-Kaap souvenirs, arts, and crafts. We strive to display accurate product descriptions, images, and prices. However, we do not warrant that product descriptions or other content is accurate, complete, or error-free.

Prices are subject to change without notice. We reserve the right to limit quantities purchased per person, household, or order. We may refuse or cancel any order at our discretion.

5. Payment and Billing

Payment must be received before your order is processed. We accept various payment methods as displayed during checkout. You represent and warrant that you have the legal right to use any payment method you provide.

All prices are in South African Rand (ZAR) unless otherwise stated. You are responsible for any applicable taxes, duties, or fees.

6. Shipping and Delivery

We will make reasonable efforts to deliver products within the estimated timeframe. However, delivery times are estimates only and we are not liable for any delays.

Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for lost or stolen packages after delivery confirmation.

7. Returns and Refunds

Due to the handcrafted and authentic nature of our products, we carefully inspect each item before shipping. If you receive a damaged or defective product, please contact us within 7 days of delivery.

Returns may be accepted at our discretion. Refunds will be processed to the original payment method within 14 business days of receiving the returned item.

8. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of BoKaap Souvenirs or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

9. User Content

If you submit reviews, comments, or other content to the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content.

You represent that you own or have the necessary rights to any content you submit and that such content does not violate any third-party rights.

10. Limitation of Liability

To the fullest extent permitted by law, BoKaap Souvenirs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless BoKaap Souvenirs and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Platform or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Cape Town, South Africa.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
